The following booking conditions form the basis of your contract with Orbit Travel Service Ltd. (hereby referred to as OTS). It is the policy of OTS to deal fairly with our clients. After all it is in our own interest as we hope you will book with us again. The following terms and conditions detail our obligations to you and what yours are to us under your agreement with us. Nothing in these booking conditions affects your statutory rights. The contract is deemed to have been concluded at our registered office, is subject to the laws of England and any dispute or claim under it will be submitted to an English court. When you place a booking with us you accept responsibility for the proper conduct of you and your party. We reserve the right to terminate your flight booking or that of any member of your party due to misconduct, and you agree to indemnify us fully if this results in any transport being delayed or diverted.
These booking conditions together with the conditions and restrictions which apply to your chosen class of air fare form the basis of your contract with OTS. You are deemed to have accepted them when you ask ourselves to confirm your booking. A binding contract between us comes into existence.
Particular requirements such as meals, wheelchair assistance or taking pushchairs should be advised when booking. We shall endeavour to pass these on to the airline, but compliance cannot be guaranteed and we will not have any liability if they are not met.
Flight timings are correct at the time of booking. However occasionally they are subject to change and so it is vital that you check your flight tickets carefully as soon as you receive them. Your flight timing should also be confirmed with the carrier 24 hours prior to departure.
It is a condition of this contract and important that you reconfirm your return flight at least 72 hours prior to departure of your return flight, in order that you may be informed of any possible last minute changes.
We are neither a carrier nor a provider of accommodation. Each journey (whether undertaken or not) that you book by air is governed by the conditions of the carrier who undertake to provide that carriage. Some of these conditions limit or exclude liability are often subject of international agreements. Copies of applicable conditions are available at the offices of the carriers concerned. It is your own responsibility to reconfirm the onward or return flight sectors of any air journey with the carrier concerned or such carrier’s duly authorised agents and according to such carrier’s regulations.
Travel and health Documents necessary to comply with the requirements of any country you may wish to visit then it is your responsibility to procure them. If failure to obtain any such documents results in fines, surcharges or any financial penalty being imposed upon us, then you shall be reimburse us accordingly. You must ensure by consulting your own doctor in necessary of specific health precautions deemed prudent for the country you intend to visit and the appropriate medication/inoculation to be complied with.
If you book full economy, business or first class flights, a deposit of £150.00 per person must be paid at the time of booking. Special fare bookings to Europe, USA, Canada, Caribbean and other destinations must be made at the time of booking. Where only a deposit is paid when booking, the balance must be paid as soon as the tickets are issued. If you fail to make a payment in full and on time, we have the right to treat your booking as cancelled by you and apply cancelation charges as set out.
Changes are sometimes are necessary by carriers although flight arrangements are made well in advance. We reserve the right to make changes to the booking. Most changes can be very minor but where they are significant we will inform you as soon as reasonably possible if there is time to do so before departure.
Please note we act as agents for our principles as well as for yourselves. If your booking is changed by our principles, we reserve the right to vary your reservation accordingly and will give you notice thereof as soon as practicable. In the unlikely event of a price increase including surcharges prior to tickets issue even though the balance payment may have been made, we reserve the right to pass on any such price increase. In such cases, we shall endeavour to offer the best possible alternative. If you do not accept the alternative we will refund in full any monies already paid, but will not be liable for any losses otherwise incurred.
After you have paid your deposit, you may wish to change some elements of the booking, we will try our best to meet your request, provided written notification is received at our office from the person who originally booked. However a charge per alteration to the booking to cover administration costs will be payable. If you change your booking, this clause does not apply to special bookings. Amendments to such flights are not permitted once a booking has been confirmed. Changes to other bookings may be possible and subject to revalidation/administration charges. Names may not be changed and must match client’s passport. Where substantial changes are to be made, it will be treated as a cancellation and be subject to cancellation charges as outlined. Name change will be treated as cancellation and tickets will be reissued subject to cancellation charges.
This clause doesn’t apply to special fare bookings, where no refunds can be given, once a booking has been confirmed if such flights are cancelled or not used. If you wish to cancel your booking after it has been confirmed, notice of cancellation must be given in writing. The cancellation will be effective from the date we receive your written notification. The cancellation fees will be charged on the scale outlined.
Please be aware that the majority of air fares are ‘SPECIAL FARES’ therefore are sold with ‘SPECIAL CONDITIONS’. The ‘SPECIAL FARE’ on our tickets are NON-REFUNDABLE and NON-CHANGEABLE once booked, meaning that you will be liable to forfeit the whole fare if you cancel, amend or fail to travel on the flight(s) you have booked. Those reservations that are cancelled and the ‘SPECIAL FARE’ ticket permits a refund, will be refunded less the applicable cancellation charge (minimum £150.00 per passenger [inc. Children and infants]). However, the minimum charge is not followed by the majority of airlines, many having a policy of refunding between 5%-25% of the fare paid. Please check with the reservation agent at time of making your reservation the applicable cancellation charge and conditions for your booking. We therefore strongly recommend you take out Travel Insurance to cover these possibilities at the time of making your reservation. Part utilised tickets and ‘no show’ passenger’s tickets (i.e. confirmed reservations not cancelled or utilised) are NON-REFUNDABLE. It is in our interest to refund the monies due to the passenger when the monies are returned to us by the airline or its agent. Lost or stolen ticket refunds are subject to approval by the respective airline or its agent, this can take in excess of 18 months for approval providing the lost or stolen ticket has not been used. Once we receive the monies we will then refund by form of CHEQUE ONLY to the lead passenger or the person whom made the payment on the passenger’s behalf originally. If payment is made by credit/debit card, it will be at our discretion whether to refund by cheque or by crediting the original credit/debit card account.
Refunds, if any, take up to 12 weeks to process and are payable only to the bookings lead name or the person who originally paid on the passenger’s behalf.
Some refunds may take longer than 12 weeks due to circumstances beyond our control.
All business is undertaken as agents only. Airline failure insurance is applicable where provided for by the airline or its General Sales Agents. We do not provide such insurance except as agents only of the airline or its General Sales Agent. Your money will not be protected against that risk.
Airline regulations vary but many refuse permission to fly those who will be 28 or more weeks pregnant on the date of their return journey. If in doubt, please check with the airline.
If you have any special requirements they should be requested at the time of booking. We will endeavour to pass all such requests on to the relevant supplier. However we cannot guarantee that any special requests will be met and failure to do so will not be a breach of contract on our part.
Orbit Travel Service Ltd. accepts no responsibility for and shall not be liable in respect of any loss or damage or alterations, delays or charges arising from unusual and unforeseeable circumstances beyond its control, such as war or threat of war, riot, civil strike, industrial disputes including air traffic disputes, terrorist activity, national and nuclear disaster, fire or adverse weather conditions, technical problems with transport, closure or congestion of airport or ports, cancellations of schedules by airlines, airline or broker failure and all similar events outside the control of ourselves or the supplier in question. We shall not be responsible for the non performance of any part of the itinerary through causes beyond our control.
